Welcome to More4Less. By accessing, browsing, or making a purchase on our website ("Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our integrated Privacy Policy and Return Policy. These terms form a legally binding contract between you and More4Less LLC. If you do not agree with any part of these terms, you must immediately cease using our services.
1. Acceptance of Terms & Conditions
These Terms and Conditions ("Terms") govern your use of the More4Less website and all services provided by More4Less LLC, a Kentucky Limited Liability Company. By completing a purchase, you are expressly agreeing to these Terms. You will be required to affirmatively accept these Terms before finalizing your order. This electronic acceptance serves as a binding signature.
2. User Accounts & Responsibilities
You are responsible for providing accurate and current information for your account and for all purchases. You are also solely responsible for maintaining the confidentiality and security of your account and password. All activities that occur under your account are your responsibility. More4Less LLC reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion if it suspects a violation of these Terms.
3. Orders, Payments & Cancellations
All orders are offers to purchase and are subject to acceptance by More4Less LLC. We reserve the right to refuse or cancel any order for any reason, including but not limited to, pricing errors, product unavailability, or suspicion of fraudulent activity. All payments are processed through PayPal. By making a purchase, you agree to abide by PayPal's terms of use. Any payment-related issues must be addressed directly with PayPal, and you agree not to hold More4Less LLC liable for any processing errors.
4. Shipping, Risk of Loss & Title Transfer
4.1. Transfer of Title and Risk of Loss
All items purchased from More4Less LLC are made pursuant to a shipment contract. The title and risk of loss for all items ordered pass to you, the buyer, upon our delivery of the items to the shipping carrier (e.g., USPS, UPS, FedEx). This transfer of ownership is a material term of this agreement. More4Less LLC is not responsible or liable for any lost, stolen, or damaged packages once they have been tendered to the shipping carrier.
Your Responsibility as Owner of the Shipped Goods: Once the package is in the carrier's possession, you are solely responsible for filing any and all claims for lost, stolen, or damaged packages directly with the shipping carrier. More4Less LLC will, upon request, provide you with all necessary shipment information, including tracking numbers and proof of shipment, to assist in your claim with the carrier.
4.2. Proof of Delivery
You acknowledge and agree that a delivery confirmation from the shipping carrier, showing the item was delivered to the address you provided, shall be considered conclusive and irrefutable proof that the item was received by you. For the purposes of any dispute, this proof of delivery will be the definitive evidence of receipt. We meticulously document the packing and shipping process, and this evidence will be used to support delivery confirmation.
5. Returns & Refunds Policy
We accept returns within 60 days of purchase. To be eligible for a return, your item must be in its original, unopened, and unused condition. Please refer to our complete Return Policy for detailed instructions. Adherence to this policy is a prerequisite for any refund consideration.
6. Product & Warranty Disclaimers
All third-party products sold on this Site are provided "as is." More4Less LLC expressly disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Any warranty is provided by the original manufacturer, and any claims related to product defects must be directed to them.
7. MANDATORY DISPUTE RESOLUTION & CHARGEBACKS
7.1. Pre-Chargeback Dispute Resolution
Before initiating a chargeback or payment dispute with PayPal or your financial institution, you agree to first contact More4Less LLC at More4less@More4lessshop.com to attempt to resolve the issue. This direct communication is a condition precedent to your right to file a dispute. Failure to comply with this requirement shall constitute a breach of these Terms.
7.2. Agreement Regarding Evidence in Chargeback Disputes
In the event you initiate a chargeback, you expressly agree that More4Less LLC will submit comprehensive evidence to PayPal and the relevant financial institutions. This evidence will include:
- Proof of your agreement to these Terms and Conditions at checkout.
- Photographic evidence of the product(s) being packed.
- A copy of the shipping label created for your order, addressed as you provided.
- The shipping carrier’s tracking information.
- Conclusive proof of delivery from the shipping carrier to your specified address.
You agree that this evidence shall be considered definitive and legally binding proof of both the shipment and your receipt of the items ordered. You acknowledge that initiating a chargeback despite the existence of this evidence may be considered "friendly fraud" or wrongful.
7.3. Collection of Unwarranted Chargebacks
More4Less LLC reserves the right to pursue collection of any wrongfully disputed funds. Should a chargeback be decided in your favor, and More4Less LLC has provided the evidence outlined above, we may, to the fullest extent permitted by law, employ a collection agency to recover the debt and may report the unpaid debt to credit bureaus.
8. Intellectual Property Rights
All content on this Site is the property of More4Less LLC or our suppliers and is protected by United States and international copyright laws. Unauthorized use is strictly prohibited.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MORE4LESS LLC OR ITS OWNER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE PRODUCTS SOLD. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT IN QUESTION.
10. Indemnification
You agree to indemnify, defend, and hold harmless More4Less LLC and its owner from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of this Site, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
11. Mandatory Binding Arbitration & Class Action Waiver
11.1. Agreement to Arbitrate
All disputes and claims relating to your use of our services or products will be resolved by **binding arbitration**, rather than in court. This arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Boone County, Kentucky.
11.2. Class Action Waiver
YOU AND MORE4LESS LLC AGREE THAT ALL DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. By agreeing to these Terms, you waive your right to participate in a class action lawsuit.
12. General Legal Provisions
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between you and More4less LLC relating to the subject matter herein.
